1. About FairGain

FairGain is operated by FairGain Tech Ltd, a company registered in England and Wales (Company No. 17177024), with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ.

FairGain is an online advertising platform that connects brands (creators/advertisers) with social media content creators (boosters/sharers). Brands launch promotional campaigns with a prize pool; boosters share Instagram stories featuring the brand, which are automatically detected, verified for duration, and rewarded.

2. Account registration

• You must provide a valid email address to register.
• You must select a role: "Brand" (creator) or "Sharer" (booster).
• You are responsible for keeping your account credentials secure.
• You must be at least 18 years old to use FairGain.
• One account per person. Multiple accounts will be suspended.

3. Campaigns (Brands)

• When creating a campaign, you deposit a prize pool via Stripe (credit/debit card). A platform commission of 2-5% is added to the charge.
• If you have wallet balance from previous campaigns, it is applied first; only the remaining amount is charged to your card.
• Each approved story mention deducts the reward amount from the prize pool.
• When a campaign ends, any unspent balance is credited to your wallet for future campaigns or can be refunded.
• Campaign payments are processed by Stripe Payments UK Ltd. FairGain does not store card details.

4. Sharing and earnings (Boosters)

• Boosters earn rewards by sharing Instagram stories that tag the campaign brand.
• Stories must remain live for the minimum duration specified by the campaign (default: 12 hours).
• A connected and verified Instagram Business or Creator account is required.
• Rewards are credited to your FairGain balance upon approval by the brand or automatic verification.
• Payout requests are processed via bank transfer (IBAN) or Stripe Connect (for international boosters).

5. Payments and fees

• Campaign payments are processed in GBP, EUR, or the currency available through Stripe in your region.
• Platform commission: 2% (Fixed mode), 2% (Split mode), or 5% (Quality mode).
• Booster payouts are processed within 5 working days of request, subject to identity verification.
• Each payout destination (IBAN or payment account) is permanently bound to one verified Instagram account to prevent fraud.

6. Prohibited activities

• Posting fake, misleading, or AI-generated story content to claim rewards
• Creating multiple accounts to exploit the platform
• Using bots, automation tools, or purchased engagement
• Deleting stories before the minimum duration to avoid verification
• Sharing the same payout destination across multiple booster accounts
• Any activity that compromises platform security or integrity

Violation of these rules may result in immediate account suspension, forfeiture of pending earnings, and permanent ban.

7. Account deletion

You may delete your account at any time from Settings. Before deletion, you must withdraw any remaining balance. Payout destinations (IBAN, payment accounts) enter a 48-hour cooldown period after deletion to prevent fraud. After cooldown, the destination can be claimed by a different verified user.

8. Limitation of liability

FairGain does not guarantee uninterrupted or error-free operation of the platform. We are not liable for disruptions caused by Instagram API changes, third-party service outages, or payment processor issues beyond our control. Our total liability to you is limited to the amount you have paid to or received from the platform in the preceding 12 months.

9. Governing law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, except where consumer protection laws in your country of residence provide otherwise.
